Privacy Policy

This Privacy Policy describes the policies of MenuMatch, LLC regarding the collection, use, and disclosure of your information in connection with your use of our websites, emails, and mobile applications (collectively, the “Services”). The terms “we”, “us”, and “MenuMatch” refer to MenuMatch, LLC. By using the Services, you consent to our collection, use, and disclosure of your information as described in this Privacy Policy.

1.    Scope of Privacy Policy. Our Privacy Policy outlines the types of information we gather when you utilize our Services, details how this information is utilized and shared, and explains your options regarding the use of your information. It also provides guidance on how you can access and modify your information. If you find any part of this Privacy Policy unacceptable, we advise you to stop using the Services. This Privacy Policy is applicable to personally identifiable information collected through the Services where this Privacy Policy is displayed.

2.    Personally Identifiable Information (PII). In this Privacy Policy, "Personally Identifiable Information" or "PII" refers to data that can identify an individual, including but not limited to their name, postal address, and email address. Additionally, when other details, like email preferences and other service-related preferences, are linked with personally identifiable information, they too are considered PII. PII is information that can be used to easily identify, contact, or locate an individual. We do not classify information as PII if it has been anonymized in such a way that it prevents a third party from readily identifying a specific individual.

3.    Information Collection. To use the Services, you may be required to furnish us with personal details. We gather PII when you sign up for the Services, actively use them, and communicate with us. Besides the information you voluntarily provide, we also accrue non-personally identifiable information through technological means, enhancing the Services' relevance and utility for you. We obtain geolocation data to tailor the Services to your needs. Additionally, we compile information like anonymous usage statistics through cookies, server logs, and other similar technologies as you interact with the Services. Below, we outline specific methods of how this information is collected and used:

a.    Account Setup and Profile Information. When setting up your account profile, we might request you to supply PII, including your name, username, email address, password, address, state, birth date, and gender. You also have the option to add other information, like health-related details and family information.

b.    Service Utilization. The information you supply while using the Services is collected by us. This might include data about your allergies, symptoms, and medications to optimize the use of our services. Additionally, if you upload a photo, we also collect the metadata associated with that photo, such as the time it was captured.

c.    Payment Processing. For payment transactions via the Services, you may be required to provide financial details, like your credit card number, to our external payment service providers. While we do not gather or keep such sensitive information, we may receive summarized transaction data that excludes credit card or bank account numbers.

d.    Communication Records. PII may be collected through your interactions with our customer support team or through other forms of communication with us, including social media interactions and registration processes.

e.    Mobile Device Geo-Location Data. If your mobile device settings permit, we may collect and store your geo-location information. Gathering this data can enhance the Services, for instance, by enabling personalized recommendations and offers or displaying nearby contacts based on your current location.

f.    Device Information and Access Permissions. The Services automatically gathers information about your device, such as the device ID and browser type, to tailor and facilitate functionalities like push notifications. You might also allow the Services to access and collect data from your device’s contact list and photo storage.

g.    Automated Data Gathering; Cookies and Similar Technologies. As you interact with the Services, it automatically collects and stores information, including anonymous usage statistics. When such data is linked with PII, the combined information is treated as PII.

While you are using the Services or opening our emails, we, along with our third-party associates such as advertising networks, social media widgets, and analytics providers, utilize "cookies" and analogous technologies to track how the Services or emails are accessed and used. Our partners may also track your online activities across different devices and on various websites or applications over time. These partners are subject to their own privacy policies. This usage aligns closely with our goal to facilitate and improve our services. By using MenuMatch, you consent to these uses of your Personal Information, which aim to provide you with a more personalized, efficient, and communicative service experience. Remember, you always have control over your communication preferences and the use of your personal data for marketing purposes. Here are specific ways in which we utilize personal information:

a.    Service Optimization. We use your information, including PII, not only for providing and improving the Services but also for analyzing how you use our Services. This helps us tailor search results and improve the overall functionality and user experience.

b.    Communication. To maintain effective communication, we may send emails to your provided email address or push notifications to your mobile device (if enabled). These communications are intended for various purposes, such as verifying your account, account management, customer service, system maintenance, and other service-related information.

However, you have the option to opt out of email marketing through the unsubscribe link in any marketing email.

This allows us to generate aggregated statistical data for the enhancement of services offered by the Services, without compromising your personal data privacy.

e.    Customized Offers. We strive to provide you with customized offers, such as dining coupons and other relevant products and services of the Services, to ensure that our offerings align with your needs and preferences.

f.    Policy Updates and Administrative Communications. We keep you informed about updates to our privacy policy and other essential administrative matters to ensure transparency and compliance.

5.    Information Disclosure. At MenuMatch, we take your privacy and the security of your personally identifiable information extremely seriously. We do not rent, sell, or share PII about you with other people or nonaffiliated companies for their direct marketing purposes, unless we have your permission. Regarding information security, we take steps to ensure your information is treated securely in line with this Privacy Policy. However, no internet transmission is entirely secure, and we cannot guarantee the security of your information. We are not liable for unintentional disclosures. Your PII can be shared in the following scenarios:

a.    Third-Party Vendors and Service Providers. We may share your PII with vendors and service providers that assist us in offering the Services. For instance, computer hosting providers and payment processors may receive PII during financial transactions.

b.    Interaction with Other Users and Visitors. The content you contribute to the Services, including your profile information, and published information, may be visible to other users and visitors. We are not responsible for other users' interactions with the information you post.

c.    Other Websites. The Services may allow you to share information, including Personal Information, with social networking sites. We only share this information if you direct the Services to do so. Their privacy policies govern their use of your information.

h.    Aggregate Data. We may anonymize or aggregate data and use or disclose it for any purpose, including marketing.

By using our Services or providing us with your PII, you acknowledge that we may communicate with you electronically about security, privacy, and administrative issues. In the event of a security breach, we will attempt to notify you electronically, such as by posting a notice on the Services or via email, and you may have the right to receive this notice in writing.

6.    Children’s Privacy. We do not intentionally gather information from children under the age of 13. In the event that we discover we have inadvertently collected such information, we will take immediate action to remove it. Our Services are not designed for, nor do we knowingly collect, maintain, or use PII from children under 13 years old. If you become aware that your child has supplied us with PII without your consent, you can contact us at info@menumatchapp.com. Should we find out that we have unintentionally gathered PII from a child under 13, we will act swiftly to delete that information and close the child’s account. If you are between the ages of 13 and 17, you must have your parent or legal guardian review and agree to these terms before you use our Services. We require your parent or legal guardian to provide their consent for the collection, use, and sharing of your PII as outlined in our Privacy Policy. Misrepresentation of age or parental consent may result in the permanent termination of your account and deletion of your personal information from our records.

7.    International Users. Your use of the Services will result in data being transferred to the United States. For users accessing the Services from the European Union or other regions with specific data collection and usage laws, your agreement to this Privacy Policy represents your consent to the transfer of your information to the United States and to global processing. By submitting your information, you are agreeing to such transfers and processing in line with this Privacy Policy.

8.    Updating Information and Making Inquiries. If you need to update or correct any information you've provided through the Services, or if you have any suggestions to improve our Privacy Policy, please reach out to us at info@menumatchapp.com. Even after fulfilling such a request, we might retain your content and information, and it may remain publicly accessible if it's disassociated from you.

9.    Changes to Privacy Policy. Our Privacy Policy may undergo revisions, so we encourage you to review it periodically. Any changes will be posted on this webpage and become effective upon posting. Additionally, if we plan to use Personal Information in ways that significantly differ from those disclosed at the time of collection, and these changes are materially less restrictive, we will make reasonable efforts to notify you and obtain consent as required by law.
